To safe-guard
the public interest, professional rules require sole-practitioners
to have a written arrangement for their practice continuity
for emergencies:
- illness -
prolonged absence
- incapacity - death
Without a "caretaker", emergencies can jeopardise
the sole-practitioner's fee income. Complaints may be filed.
Clients may leave the sole-practitioner if their work is held
up. |
InPractice model agreement is a
one way contract between a sole practitioner and their "caretaker".
Most sole-practitioners do not wish to be bound by a reciprocal
agreement. If reciprocation is required, produce the same agreement
with the names reversed.
The clauses specify how clients' work will be looked after by the
caretaker in emergencies, and how the caretaker will be remunerated
for keeping the practice and its assets intact during absence and
even death.
Unless verbal arrangements with the "caretaker" are in
writing, time can fade the understanding of the obligations, rewards
and other terms. Avoid heart-aches and misunderstanding with this
easy-to-use model agreement. The estate has to be managed actively
until probate is obtained.
Since it is expensive and inconvenient to rip up an agreement and
re-write it for changes such as profit %, this model agreement uses
the device of attaching "Schedules". Changes can be made
by replacing Schedules signed by all the partners.
